Agreeing to these terms
These Terms of Use apply to your use of this website (the “Site”), operated by Bridgecrest Advisory Group, LLC (“Bridgecrest,” “we,” “us” or “our”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
What the Site is — and isn’t
The Site describes Bridgecrest and the recruiting, search and HR advisory services we offer. It is for general information only.
- It is not an offer of employment. Nothing on the Site is an offer of a job, or a promise that any role exists or remains open.
- It is not a guarantee of placement. We cannot promise that any candidate will be offered, or accept, a particular role, or that any search will result in a hire.
- It is not professional advice. Nothing on the Site is legal, tax, immigration, employment-law or financial advice. Please consult a qualified professional about your own situation.
Our services are governed separately
When a company engages us to conduct a search or provide HR advisory services, the engagement is governed by a separate written agreement setting out fees and terms. If that agreement conflicts with these Terms of Use, the agreement prevails. Using the Site does not, on its own, create any client, agency, employment or fiduciary relationship between you and Bridgecrest.
If you are a candidate
- Please be accurate. Information you give us about your experience, qualifications and work authorization should be true and complete. We rely on it when we represent you to clients.
- Referees. If you give us a referee’s contact details, please make sure they are happy to be contacted.
- Your information is handled as described in our Privacy Policy and Candidate Privacy Notice. We will not put you forward for any role without your permission.
Using the Site properly
You agree not to:
- use the Site in any way that breaks the law or infringes anyone’s rights;
- attempt to gain unauthorized access to the Site, its servers or any connected system, or interfere with how the Site works;
- use automated means — such as scrapers, bots or crawlers — to collect information from the Site, other than standard search-engine indexing;
- send us anything containing viruses or other harmful code; or
- impersonate anyone or misrepresent your affiliation with any person or organization.
Intellectual property
The Site and its content — including text, graphics, design, the Bridgecrest name and the bridge mark — belong to Bridgecrest or are used with permission, and are protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, adapt, distribute or use them without our written permission.
The Bridgecrest name, logo and bridge mark are our trademarks. Nothing on the Site grants you any right to use them.
What you send us
When you email us or send us a résumé or other material, you confirm you have the right to share it, and you allow us to use it to respond to you and provide our services, as described in our Privacy Policy. Please do not send us anything confidential belonging to your current or former employer.
Links to other websites
The Site may link to websites run by others. We do not control them and are not responsible for their content, availability or privacy practices. A link is not an endorsement.
Disclaimers
We work to keep the Site accurate and available, but it is provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties of any kind about the Site, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure or free of errors.
Limitation of liability
To the fullest extent the law allows, Bridgecrest will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or opportunity, arising out of or relating to your use of, or inability to use, the Site — even if we have been told such damages are possible.
To the fullest extent the law allows, our total liability for any claim arising out of or relating to the Site is limited to one hundred US dollars (US $100).
Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited, so some of the above may not apply to you. Nothing in these terms limits any liability that cannot be limited by law.
Indemnity
You agree to indemnify and hold harmless Bridgecrest and its owners and representatives against any claims, losses and reasonable expenses, including legal fees, arising out of your breach of these terms or your misuse of the Site.
Governing law and disputes
These terms, and any dispute arising out of or relating to them or to the Site, are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-laws rules. You agree that the state and federal courts located in the State of Florida have exclusive jurisdiction over any such dispute, and you consent to their jurisdiction.
Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top shows when they last changed. Continuing to use the Site after a change means you accept the updated terms.
General
If any part of these terms is found unenforceable, the rest remains in effect. Our not enforcing a right is not a waiver of it. These terms, together with the documents they refer to, are the entire agreement between you and us about the Site. You may not transfer your rights under these terms; we may transfer ours to a successor business.
